Abstract:
This thesis explores the investigation and prosecution of white-collar crime in Ireland with a view to evaluating current law and practice and presenting a vision for reform. The focus of the enquiry is core aspects of the investigative and prosecutorial process, namely adjectival laws and doctrines, legislative and common law powers, and constitutional rights. The position taken in the thesis is that the investigation and prosecution of white-collar crime should be the subject of a dedicated statute that consolidates beneficial aspects of the current regime, amends areas that are in need of reform, and provides a context for the future development of law and practice
